A Fiduciary is a professional agent who must uphold certain legal and ethical responsibilities. The Fiduciary Responsibility is one that carries with it a Duty of Loyalty and a Duty of Care. The Duty of Loyalty means that the agent must act in the best legal and ethical interest of the person or entity it is representing. The Duty of Care means that the agent must act in a manner to avoid unnecessary or avoidable harm to the person or entity it is representing. Ultimately, the fiduciary agent must act in the best interest of the principal party.

Failure to uphold this responsibility usually means that the agent is responsible for making the principal whole again. Often times this means removal from the role, monetary damages, and return of fees.

HOW DOES A PROFESSIONAL FIDUCIARY SERVE?

A professional fiduciary is an independent individual or organization appointed to manage financial or legal responsibilities on behalf of another person or trust. Their role is to make decisions and handle responsibilities with the highest level of trust, always prioritizing the client’s best interests.

Often times people will select individual family members or friends to serve in this role. A professional can sometimes be required or preferred in certain circumstances. Not every situation is the same, and not every need is the same. A professional fiduciary is important when a complex need arises or if there are no individuals willing or able to take on the responsibility.
